and her former boyfriend, raf l raffaele sollecito. knox who lives and attends college in her hometown of seattle stayed up until 2:00 a.m. to hear her fate. her lawyers tell abc news, she's incredibly sad. this morning a stunning reversal in the acquittal of amanda knox as she now will have to face an entirely new trial. more than 18 months since she was freed and after serving four years in a perugia jail both knox and her then-boyfriend rafaelle sollecito are now back to step one. both families' worst nightmares. >> she's shocked. she's very sad. she thought this was the end of a nightmare. but she's also very strong in the sense that she's willing to fight again. >> reporter: the knox family released a statement saying it was painful to receive the news that the italian supreme court decided to send my case back for revision. back in 2011 defense lawyers and experts revealed how evidence was contaminated or poorly handled by forensic teams. [ speaking a foreign language ] >> reporter: and successfully argued their release with knox flying home to seattle and
7:01 am
sollecito to southern italy. but the prosecution hit back, demanding a retrial. arguing to the supreme court that the acquittal was a rare mix of violation of the law and illogicalness, saying the judge who acquitted them had quote lost his way. a difficult day for both families today. it also happens to be sollecito's 29th birthday. no word on whether knox and sollecito have had any contact since the news broke. george? >> okay, thank you, lama. let's get more from amanda knox's attorney ted simon. good morning, ted. thank you for joining us. as we said, you broke the news to amanda this morning. how did she take it? >> well, let's be clear. carlo dalla vedova broke the news to amanda this morning. yes, amanda took it -- it was painful. she's issued a statement it was very painful to receive that difficult news. we were certainly hopeful that the supreme court would simply affirm the correct ruling of the appellate court.
7:02 am
but let's be very clear here. there was never any evidence in this case. and whatever evidence was reviewed was considered absent, nonexistent, unreliable, or simply inaccurate. and that has not changed. >> well then why is the supreme court saying there should be a retrial? >> they're not exactly saying that. they're sending it back for revision and review. she still remains not guilty. nothing has changed. there never was any evidence of her guilt and there never will be any evidence of her guilt. so all this is is sending back for revision and we have to wait for the specific directives from the supreme court as to the basis of their ruling. >> so what is next for amanda? will she return to italy for the trial? >> and let's be clear about that too. both amanda and the family have always abided by all rules and regulations and the rule of law. and in this particular case to the extent it's being sent back for revision, her appearance is not required. so we're many, many, you know -- there's a great deal of time
7:03 am
that will elapse. this case will continue to be fought. she remains strong and vigilant and one thing we can say about amanda and her family they have showed an unquestioned resilience and fortitude and courage in the face of these absolutely unjustified allegations. there simply is no evidence. there never was. there never will be. >> you point out the legal steps. if amanda is, indeed, convicted in this retrial and that is upheld by the italian supreme court, italy could extradite her. would you then petition the united states government to block the extradition? >> yeah, again, let's be clear. all we have is the matter being sent back for revision in the appellate court. and they will review it. there's no reason to believe even upon that review there will be anything other than a finding of not guilt. but if there is something different than that, it will be appealed back to the supreme court of italy. where we hope there also would be a favorable ruling. questions of extradition are
7:04 am
really not within the legal landscape at this point of time. but i can assure you the family as well as amanda, will abide by the rule of law as they always have. >> ted simon, thank you very much. all right, george, "gma" legal analyst dan abrams joins us now picking up a bit on what ted said there and looking at it. what is your take on what happened today? >> well, look, this is a surprising ruling. any time an appellate court comes in and says that a different court got it wrong, it's surprising. what this high court said is that there were some mistakes of law made in the lower court, not necessarily that she's guilty, just that there were errors in law such that the lower court needs to review the case. but that's a big deal. and as a result, there could be issues down the road with regard to extradition. ted is absolutely right. that for now amanda knox will not be going back to italy. but, if the lower court deems that she is guilty, and the appellate court, the high court,
7:05 am
affirms that ruling, i think that the italian officials could then request that she be extradited. and there could be a battle. i think it's unlikely that the u.s. would go along with that. i think they would claim this is effectively double jeopardy. she's being tried again in a way that you wouldn't do in the united states and as a result, they'd likely say no but it's not a necessarily a no. >> and this is going to happen in 2014, but still we're talking years here. there could be an appeal from that appeal. i mean, when is this going to end for her? >> absolutely. this is going to be a many years long process. so for amanda knox, as a practical matter, this is not going to have an impact on her for now. for the next year or two years. the only immediate impact is she might have been or likely would have been entitled to get paid back for false imprisonment for the time she served. now she likely would not be able to get that. but apart from that, this is not going to affect her life until they request extradition. that would mean the high court would have to affirm again. >> we have not heard from amanda knox.
7:06 am
she is releasing her memoir the end of next month. is that a wise move to continue with that given these proceedings in italy? >> look, i think it's important from her perspective to live her life. for her to say, you know what? i'm not guilty. an appellate court found me not guilty. yes, a court is reviewing this case, but i'm moving on. obviously, if there is a conviction again, if the high court affirms that, i don't know that she'd want to be traveling in the eu on a book tour, but apart from that, i don't think it should impact her. >> thank you. >> as that memoir comes out she'll speak to diane sawyer for the first time. that will air april 30th, at 10:00 p.m., right here on abc. now to the supreme court where history will be made when the justices hear arguments this morning on whether gay marriage is a right guaranteed by the constitution. spectators have been lining up outside the court for days and our court expert "nightline" anchor terry moran is there. good morning, terry. >> reporter: good morning, george. here at the supreme court, it's on. the moment hads arrived.

today, the supreme court hearing the arguments that millions of americans have waited for and struggled for. millions of others have looked toward with anxiety and concern. the six men and three women, the nine justices of the supreme court, hearing those arguments today on that huge issue. what is the meaning of marriage in america today? and does it include our fellow citizens who are gay? outside the supreme court overnight a candlelight vigil for proponents of same-sex marriage. it's a debate that touches countless american families. and in the line outside the court for one of the 60 or so seats inside, a line that began last thursday, that great debate continues. >> yeah, i would hope to get married because i'm a gay man and i'm from california, so i would like to get married in my home state. >> i'm a huge supporter of marriage. i'm a christian and i hold the traditional biblical values. >> all: no more hate!

and investigators are now trying to figure out ties between the killing and white supremacist prison gangs. dan harris is here with more on that. good morning. >> reporter: good morning to you. this crime is opening up a window into the ultra violent and expanding world of white supremacist gangs. this as we hear from the victim's family for the first time. >> tom and i were watching tv and our doorbell rang, and my life was forever changed. >> reporter: tom clements' anguished widow speaking at a memorial service on the same day police confirmed the gun used to murder the colorado prison chief at his front door was also found on prime suspect evan ebel days later after a fatal shootout in texas with police. >> we still have a lot of investigation to do to determine, you know, what else happened, what was the motive, who else may have been involved? >> reporter: abc news has learned that investigators suspect ebel also killed a pizza delivery man to use his uniform as a disguise as he approached clements' home. ebel was a member of a white supremacist prison gang called the 211 crew. there are estimated to be tens of thousands of white supremacist gang members in

american prisons, ranging from local outfits like the 211 to national ones like the aryan brotherhood, the subject of this national geographic investigation. >> the reality is is that the public hasn't known all that much about these gangs in the past because they've been largely confined to within the prison walls. but that's changing. >> reporter: they sell drugs and run guns and it's all orchestrated from behind bars by shot callers who communicate by using elaborate codes. >> the 211 crew, for instance, must engage in criminal enter prizes to raise money that is then sent back to the so-called shot callers or the leaders in the prison cells. >> reporter: in fact, in the months before he was killed, tom clements was apparently so worried about the growing power of the 211 crew, he tried to break the gang up, moving members to different institutions. investigators are now looking into whether his murder was in retaliation for that move. george? >> okay, scary stuff, thank you, dan. >> all right, george. now to that big win for tiger woods that put him back on

is going to become very relevant. but i think this is the kind of case that you might see them reach an agreement before this goes to trial. >> i guess the agreement would be something about turning over the letters once and for all. >> remember, she still has all those letters. so the family has got to be very concerned. it seems there's something in these letters that the family doesn't want out there. there's -- for some reason this is embarrassing or whatever the case may be. so the fact that she still has those letters gives her leverage. you hear her lawyer still talking about the fact that she still has those letters. so that's going to be a very important question when discussing it. >> why hasn't she had to turn them over? >> her lawyer says she obtained them legally. they're suing to get them back. we'll see how that gets resolved. that's a separate case, a civil action. we're talking about the criminal action of extortion. and civil cases tend to take a long time. so it may be a while before she gets back those letters, if at
